TERMS & CONDITIONS

1. Provision of Courses and Programmes

Leomilla di Kenez, operating under the name Accademia Leomilla, with its registered office in Castelfiorentino, Tuscany, Italy (the “School”), provides language courses, educational programmes, language stays and related services (the “Course” or “Programme”) subject to these Terms & Conditions, the booking and the School’s written acceptance, which together form the Contract.

The School offers language courses in Italian for foreigners, English and other languages, as well as educational and cultural programmes for individual students and groups.

The School may update these Terms & Conditions from time to time. The Terms applicable to a booking are those in force at the time the booking is accepted.

If the Course or Programme booked by the Student is no longer available, the School will inform the Student or Agent as soon as reasonably possible and, where possible, offer a suitable alternative.

If no suitable alternative can be provided, the School may cancel the booking and refund any amounts paid for the unavailable Course or Programme, subject to any applicable legal rights.

2. Booking and Payment

All bookings are subject to the School’s written acceptance.

A booking is considered confirmed only after the School has accepted the booking and the required deposit or payment has been received.

Unless otherwise stated in the specific quotation or booking confirmation, a 30% deposit per student is required to confirm the booking.

The deposit is non-refundable except where otherwise required by applicable law or expressly agreed in writing by the School.

The School may issue an invoice for the remaining Course or Programme fees after acceptance of the booking.

Unless otherwise specified in the booking confirmation, full payment must be received no later than 28 days before the Course or Programme Start Date.

For bookings made less than 28 days before the Start Date, full payment may be required at the time of booking.

All payments shall be made in Euro (€).

Any bank charges, payment processing fees or other costs arising from the payment method selected by the Student or Agent may be charged to the Student or Agent where applicable.

The School reserves the right to adjust the price before the Start Date where this is necessary due to significant increases in costs outside the School’s reasonable control, including accommodation, transport, entrance fees or other services included in the Programme, subject to applicable law and the Student’s statutory rights.

Where the booking constitutes a package travel contract, any price modification will be subject to the applicable Italian and European legislation governing package travel.

3. Cancellations

All cancellations must be submitted in writing by the Student, parent/guardian or Agent.

The School will acknowledge the cancellation in writing.

Unless different cancellation conditions are stated in the specific quotation or booking confirmation, the following cancellation charges shall apply:

  • More than 90 days before the Start Date: deposit retained as an administration/cancellation charge;
  • Between 90 and 60 days before the Start Date: 50% of the total Course or Programme fee;
  • Between 60 and 30 days before the Start Date: 75% of the total Course or Programme fee;
  • Less than 30 days before the Start Date or non-arrival: 100% of the total Course or Programme fee.

The School may retain amounts already paid up to the applicable cancellation charge.

Where a refund is due, the remaining amount will be refunded within the applicable legal timeframe.

Cancellation charges may be different where specific services included in the booking, such as flights, accommodation, entrance tickets or other third-party services, are subject to non-refundable or specific cancellation conditions. Such conditions will be communicated to the Student or Agent where applicable.

Where mandatory consumer or package travel legislation provides different cancellation or refund rights, those legal rights shall apply.

4. Course or Programme Changes

The School reserves the right to make reasonable changes to a Course, Programme, timetable, teacher, venue, accommodation or activities where necessary due to circumstances beyond its reasonable control, availability, safety requirements or other operational reasons.

Where a significant change is required, the School will inform the Student or Agent as soon as reasonably possible and, where appropriate, offer a suitable alternative.

If a significant change materially affects the main characteristics of a package travel contract, the Student will have the rights provided by the applicable legislation.

The School may also cancel a Course or Programme where the minimum number of participants required to operate it is not reached or where circumstances outside the School’s reasonable control make the Programme impossible or unsafe to operate.

In such cases, the School will offer an appropriate alternative where possible or provide any refund required by the applicable terms and legislation.

5. Visas and Entry Requirements

The Student is responsible for ensuring that they have the correct passport, visa, residence permit and other documentation required to enter and stay in Italy.

The School may provide reasonable assistance and supporting documentation for visa or other entry applications where applicable.

Any documentation issued by the School will be provided only after the booking has been confirmed and, where required, payment has been received.

The School cannot guarantee the approval of a visa or entry permit.

If a visa application is refused, the Student must provide the School with official evidence of the refusal.

Any refund will be subject to the applicable cancellation conditions, the terms of the specific Programme and applicable law.

Non-refundable third-party costs may be deducted where legally permitted and where these costs have already been incurred.

6. Insurance

Students are strongly recommended to have appropriate travel and personal insurance covering, where relevant:

  • medical expenses;
  • accidents;
  • personal belongings;
  • travel cancellation;
  • interruption of the Course or Programme;
  • loss of documents;
  • personal liability;
  • repatriation.

For international students and minors, appropriate medical and travel insurance may be required as a condition of participation.

The School may offer or arrange travel insurance where available, but the Student or Agent remains responsible for ensuring that the chosen insurance provides adequate coverage.

7. Liability

The School will provide the Course or Programme with reasonable care and professional standards.

To the extent permitted by applicable law, the School shall not be liable for loss, damage, costs or expenses arising from circumstances outside its reasonable control.

This may include, without limitation:

  • strikes;
  • transport disruption;
  • natural disasters;
  • extreme weather;
  • epidemics or public health emergencies;
  • war or threat of war;
  • terrorism;
  • government restrictions;
  • cancellation or delays of flights or other transport;
  • actions or failures of third-party service providers.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under Italian law, including liability for death or personal injury caused by the School’s negligence where applicable.

Where the School acts as organiser of a package travel contract, the liability provisions applicable to package travel under Italian and European law shall apply.

8. Students and Participation

Students are expected to behave respectfully towards teachers, staff, host families, accommodation providers, other students and members of the local community.

Students must comply with:

  • School rules;
  • accommodation rules;
  • programme schedules;
  • safety instructions;
  • applicable Italian laws and regulations.

The School accepts students on the understanding that all relevant medical, health, dietary or accessibility information has been communicated in advance where such information may affect the student’s participation or safety.

Parents or legal guardians are responsible for providing accurate information concerning minors.

Illness or Injury

In the event of illness or injury, the School will take reasonable steps to assist the Student and, where necessary, contact the parent, guardian or emergency contact.

In the event of a medical emergency, the Student will be taken or directed to the appropriate emergency medical service.

Any medical, hospital, pharmaceutical or other personal expenses not covered by the Student’s insurance shall normally be the responsibility of the Student or their parent/guardian.

Activities

Students participate in sports, excursions, cultural activities and other programme activities subject to the applicable safety instructions and rules.

Additional parental or guardian consent may be required for minors participating in certain activities.

Damage Deposit

Where applicable, students staying in accommodation arranged by the School may be required to pay a €100 damage deposit on arrival.

The deposit will be returned at the end of the stay, provided that no damage, loss or additional costs attributable to the Student have occurred.

The School reserves the right to deduct documented costs resulting from damage or loss from the deposit.

9. Exclusion and Expulsion

The School reserves the right to exclude or expel a Student from a Course or Programme where, in the School’s reasonable opinion, the Student has engaged in serious misconduct or behaviour that creates a risk to themselves, other students, staff, accommodation providers or third parties.

Serious misconduct may include, without limitation:

  • possession, purchase or use of illegal drugs;
  • possession or use of alcohol where prohibited, particularly by minors;
  • violent, threatening or abusive behaviour;
  • bullying or harassment;
  • theft or shoplifting;
  • deliberate damage to property;
  • possession of weapons or prohibited items;
  • serious breach of accommodation or School rules;
  • any other serious offence or behaviour contrary to applicable law.

In serious cases, the Student may be removed from the Course or Programme with immediate effect.

For minors, the School will contact the parent, guardian or responsible Agent as soon as reasonably possible.

If a Student is expelled due to serious misconduct, no refund will normally be provided for the unused part of the Course or Programme, to the extent permitted by applicable law.

Any additional costs resulting from the Student’s expulsion or early return, including travel costs, shall normally be borne by the Student or their parent/guardian where the expulsion results from the Student’s misconduct.

10. Complaints

Students should report any problem or complaint to the School as soon as possible during the Course or Programme so that the School has the opportunity to resolve the issue promptly.

Complaints concerning a Course or Programme should normally be submitted as soon as possible and, where appropriate, within 28 days after the end of the Course or Programme.

The School will review the complaint and provide an appropriate response within a reasonable timeframe.

Nothing in this section limits any mandatory consumer rights or legal remedies available to the Student under applicable Italian or European law.

11. Personal Data

The School processes Students’ personal data in accordance with applicable data protection legislation, including the EU General Data Protection Regulation (GDPR) and applicable Italian legislation.

Personal data may be processed for purposes including:

  • student registration;
  • Course and Programme administration;
  • accommodation management;
  • communication with Students, parents, guardians and Agents;
  • payments and invoicing;
  • emergency and safeguarding purposes;
  • legal and administrative obligations.

12. General

These Terms & Conditions, together with the booking confirmation, quotation and any specific Programme conditions provided to the Student or Agent, form the agreement between the School and the Student/Agent.

If there is any conflict between these Terms & Conditions and mandatory provisions of applicable law, the mandatory legal provisions shall prevail.

The Contract shall be governed by the laws of Italy.

Where the Student is a consumer, any mandatory consumer protection rights and applicable rules concerning jurisdiction shall apply.

The School’s website, brochures and promotional materials are published in good faith. Programme details, prices, accommodation, activities and services may be subject to change and the specific booking confirmation shall prevail for the services actually booked.
